ACA Member Advisory: Prompt Payment

The Government of Alberta passed November 4^th amendments to Bill 37: Builders’ Lien (Prompt Payment) Amendment Act, 2020. These amendments addressed some of ACA’s concerns.

Alberta Construction Association supports legislative changes which:

• Mandate progressive release of holdback – amendment calls for mandatory progressive release
• Extend the length of the period of liens protection – Bill 37 extends to 60 days
• Mandate a set length for payment timelines – amendment mandates 28 / 7/ 7 regime
• Mandate adjudication to resolve payment disputes – Bill 37 mandates adjudication

ACA appreciates the opportunity to provide technical expertise to assist in drafting future regulations to implement the legislative changes.

ACA also looks forward to partnering with other stakeholder organizations to propose serving as an Authorized Nominating Authority that will provide cost-effective dispute adjudication by recognized industry experts.
